MyBrokerBase is a workflow tool for commercial mortgage brokers. It does not provide financial advice, credit advice or any regulated financial service. All outputs must be independently verified.
1. Not Financial Advice
MyBrokerBase is a workflow and productivity tool. Nothing within the platform, its outputs, calculations or generated documents constitutes:
- Financial product advice within the meaning of the Corporations Act 2001 (Cth)
- Credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth)
- Legal, accounting or tax advice of any kind
- A recommendation to enter into any financial transaction
2. Broker Responsibility
All users of the platform are solely responsible for:
- Independently verifying all calculations, figures and outputs generated by the platform
- Ensuring all advice and recommendations to clients comply with applicable laws and regulations
- Holding and maintaining all required licences and authorisations for their broking activities
- Complying with obligations under their Australian Credit Licence (ACL) or AFSL
- Performing their own due diligence on all transactions
3. Calculation Accuracy
MyBrokerBase performs calculations based on data entered by the user. The accuracy of all outputs is entirely dependent on the accuracy of data input. We make no warranty as to the accuracy, reliability or completeness of any calculation or output generated by the platform.
Factors that may affect accuracy include:
- Incorrect or incomplete data entry
- Changes to tax rates, HEM benchmarks or lender assessment policies
- Regulatory changes affecting assessment methodologies
- Differences between platform methodology and individual lender policies
4. HEM and Assessment Rates
Household Expenditure Measure (HEM) benchmarks are based on publicly available data and updated periodically. However:
- Individual lenders may apply different HEM benchmarks or methodologies
- Lenders may apply additional assessment criteria not reflected in the platform
- Assessment rate buffers are indicative only — lenders set their own assessment rates
- Platform outputs should not be represented to clients as guaranteed lender assessment outcomes
5. PDF Outputs and Credit Memoranda
Credit memoranda and other PDF documents generated by the platform are working documents only. They do not:
- Represent a completed or compliant credit assessment for regulatory purposes
- Guarantee lender acceptance of a credit application
- Constitute a credit contract, credit guide or any other regulated document
- Replace the broker's obligation to conduct independent credit assessment
6. Regulatory Compliance
It is the sole responsibility of the user to ensure their use of the platform and any outputs comply with:
- National Consumer Credit Protection Act 2009 (Cth)
- Corporations Act 2001 (Cth)
- ASIC regulatory guides and pronouncements
- Privacy Act 1988 (Cth) in respect of client data
- Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
- Requirements of their aggregator or licence holder
7. Limitation of Liability
To the maximum extent permitted by law, George and Albion Pty Ltd accepts no liability for any loss, damage, claim or expense arising from reliance on any calculation or output generated by the platform, errors in data entry, regulatory non-compliance by the user, or any decision made based on platform outputs.
8. Professional Advice
Users are strongly encouraged to seek independent legal, financial and compliance advice in relation to their obligations as licensed brokers. This platform is a tool to assist with workflow efficiency — it does not replace professional judgement.
